Campaigns, Elections, Ethics & Policy Law

Our team provides comprehensive legal, compliance, and operational guidance to candidates, campaigns, political action committees, nonprofit and social welfare organizations, public officials, and other entities involved in the political, electoral, and public-policy process. Services include:

Advise candidates, campaigns, political action committees, and nonprofit and social welfare organizations regarding campaign finance laws, contribution sources limits, appropriate expenditures, fundraising, reporting requirements, budgeting, and ongoing regulatory compliance.

Establish and structure candidate committees, 527 organizations, 501(c)(4) organizations, independent-expenditure-only committees/Super PACs, leadership PACs, and political action committees. Prepare and establish Joint Fundraising Agreements (JFAs), including participating committee agreements, allocation structures, fundraising notices, and related compliance documentation.

Provide guidance and assistance regarding organizational governance and regulatory requirements, including incorporation, Secretary of State filings, IRS EIN applications, bylaws, organizational resolutions, governance documents, Statements of Organization, and registrations and filings with the Louisiana Board of Ethics and other applicable regulatory agencies.

Assist with establishing and managing campaign, PAC, nonprofit, JFA, and organizational bank accounts; prepare banking resolutions and authorized signatory documentation; coordinate contribution deposits and disbursements; initiate and process wire transfers; maintain supporting banking documentation; and assist with ongoing financial compliance.

Prepare, review, and analyze campaign finance reports for compliance with applicable reporting requirements. Prepare and assist with Louisiana Board of Ethics forms and disclosures, including Statements of Organization, candidate and committee reports, special reports, amendments, fundraiser disclosures, and other required campaign finance and ethics filings.

Work directly with accountants, campaign professionals, treasurers, and organizational leadership to reconcile financial activity, review contributions and expenditures, determine appropriate reporting classifications and descriptions, identify and address reporting discrepancies, and facilitate accurate and timely campaign finance reporting.

Advise regarding contribution limits, permissible and prohibited sources, joint fundraising arrangements, independent expenditures, donor restrictions, in-kind contributions, contribution allocation and reallocation, refunds, and other fundraising compliance matters.

Represent and advise candidates and political organizations regarding challenges to candidate qualifications, injunctions against misleading political advertising, and other election-related legal proceedings and compliance matters.

Provide continuing guidance regarding Louisiana ethics laws, campaign finance requirements, financial disclosure obligations, regulatory filings, organizational governance, and compliance issues throughout the election cycle.

Provide counsel to elected officials and public servants regarding the Louisiana Code of Governmental Ethics and represent clients regarding ethics investigations and charges.

Research and analyze proposed legislation, ordinances, rulemakings, regulations, and policy initiatives. Provide guidance regarding the legal, regulatory, and practical implications of proposed changes to law.

Draft public records requests and research public records for information useful to clients.
